International Child Abduction

International child abduction is a frightening thought, especially if you are married to a foreign national. The Hague Convention on the Civil Aspects of International Child Abduction will assist if the child is taken to a member country. However, prevention is always the best remedy. Attached is a link to a list, prepared by the experts, of the ten things to consider when developing a parenting plan. A parenting plan is more than just an outline of the care schedule. Like a well negotiated contract, a good parenting plan addresses all the likely issues that may arise during the children's future development. For example, can a step-parent discipline the child or can the child participate in certain activities.

Use Caution When Emailing Your Attorney

Many, if not most, of our clients communicate with us during the day from their employer's email accounts. Attorney-client communications are ordinarily privileged - meaning the content or fact of communication cannot be revealed in any litigation. However, there is a risk that these emails will be read by your employer and the law is certainly not clear if your privilege will be protected. Click here for an interesting discussion.

Future of Family Law Education

Two of WB&D attorneys, Nancy Zalusky Berg and Gary Debele, attended the Future of Family Law Education conference on June 26, 2009 hosted by the Midwest Family law Consortium. When asked to advise the law professors present on what new lawyers need to know about family law:
Nancy Zalusky Berg of the firm Walling, Berg, & Debele said, "Get yourself out of the way." She commented on the importance of family law attorneys understanding themselves and how their own experience of family can impact their representation of their clients. Gary Debele of the same firm advised new lawyers to think of themselves as problem solvers first rather than advocates and litigators. As a problem solver, he suggests three key questions: "What does the client want? Is what the client wants, reasonable and feasible? And How do you get to that result?"

Because social media is the "next hot thing" that is where you will find the outrageous behavior. Be careful what you do on these social media sites. Nothing is private. Whatever you put in writing can be viewed by anyone forever. I have used evidence from myspace to present evidence to the court of a mother's inappropriate behavior. --Nancy Zalusky Berg
